These terms govern your purchase and use of BenchRecon research briefs.
Service Description
BenchRecon provides per-case federal sentencing research exhibits compiled from United States Sentencing Commission public datafiles. Each brief presents comparable case distributions for a specific offense level, criminal history category, and district cell.
Briefs are delivered as PDF and DOCX attachments via email following payment confirmation. Delivery typically occurs within 24 hours of a completed purchase.
Eligibility
BenchRecon is intended for use by licensed attorneys and their authorized staff. By purchasing a brief you represent that you are a licensed attorney or are acting under the supervision of one.
Warranty Disclaimer
BenchRecon briefs are public-records data exhibits provided AS-IS without warranty of merchantability or fitness for a particular purpose. Counsel is responsible for verifying every datafile citation and for the legal judgment of how the data applies to a specific case. BenchRecon's liability is limited to the purchase price.
The data in each brief is drawn directly from USSC public datafiles and reflects the Commission's published records. BenchRecon makes no representation that any particular cell distribution will support any particular sentencing argument. The brief reports what the Commission published — the legal judgment is counsel's alone.
Not Legal Advice
BenchRecon briefs are research assistance tools. They are not legal advice and do not establish an attorney-client relationship of any kind between the purchaser and BenchRecon.
Limitation of Liability
To the maximum extent permitted by applicable law, BenchRecon's aggregate liability for any claim arising out of or related to a brief is limited to the amount paid for that brief. BenchRecon is not liable for indirect, incidental, consequential, or punitive damages of any kind.
Refunds and Corrections
Refund and correction terms are set out in the Refund Policy, which is incorporated by reference into these terms.
Intellectual Property
The brief format, composition methodology, and delivery infrastructure are proprietary to BenchRecon. The underlying USSC sentencing data is public-domain government data. Purchasers may use their delivered brief for the case matter for which it was purchased. Resale or redistribution of brief files is prohibited.
Governing Law
These terms are governed by the laws of the State of California without regard to conflict of law principles.
